Effective Date: January 1, 2026
By accessing or using the website at somertonconcrete.com (the "Site") or by engaging Custom Somerton Concrete ("we," "us," or "our") for any concrete services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our Site or services.
Custom Somerton Concrete provides concrete contracting services including, but not limited to, driveway installation, patio construction, foundation work, sidewalk building, decorative concrete, retaining walls, pool decks, floor installation, and related concrete services. Services are provided to residential and commercial customers in Somerton, AZ and surrounding communities.
All estimates provided by Custom Somerton Concrete are free of charge and represent our best assessment of project costs based on an on-site evaluation. Estimates are not binding contracts.
Final pricing is confirmed in a written proposal or contract before work begins. Any changes to the project scope requested after the proposal is signed may result in adjustments to the total cost. We will communicate any changes in writing before proceeding with additional work.
We will make every reasonable effort to complete work on the agreed schedule. Delays may occur due to weather, material availability, or circumstances outside our control. We will notify you promptly if a scheduled date needs to change.
If you need to cancel or reschedule a confirmed appointment, please contact us as soon as possible. Cancellation of a signed contract may be subject to cancellation fees as specified in the contract. We reserve the right to reschedule jobs due to conditions that make it unsafe or impractical to work.
Payment terms are outlined in the written contract for each project. A deposit may be required before work begins. The remaining balance is due upon completion of the project unless otherwise agreed in writing.
Accepted payment methods will be specified in your contract. Late payments may be subject to interest charges as permitted by applicable law. We reserve the right to suspend or terminate work on a project if payment obligations are not met.
We stand behind our work and aim to deliver concrete installations that hold up over time. Any specific warranty terms will be provided in your written contract.
Warranty coverage does not extend to damage caused by misuse, neglect, acts of nature, or modifications made by parties other than Custom Somerton Concrete. Normal concrete behavior, including minor hairline cracking due to curing or temperature changes, is not considered a defect.
To the fullest extent permitted by applicable law, Custom Somerton Concrete shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our Site or services, even if we have been advised of the possibility of such damages.
Our total liability for any claim related to a specific project shall not exceed the amount paid by you for that project. Nothing in these terms limits our liability for fraud, gross negligence, or any other liability that cannot be excluded by law.

You agree not to use the Site in any way that could damage, disable, or impair its operation.
If a dispute arises relating to our services or these Terms and Conditions, both parties agree to first attempt to resolve the matter through good-faith negotiation. If negotiation does not resolve the dispute, the parties may pursue mediation before initiating formal legal proceedings. Nothing in this section prevents either party from seeking emergency injunctive relief where appropriate.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal proceedings related to these terms shall be brought in the appropriate courts located in Arizona.
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site or services after changes are posted constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.
